Terms of Service & Sales

Plain-English terms for reserving and buying a MANA ECU from NextGear Web Services. If anything here is unclear, email us before you put money down.

1. Off-road / motorsport use only

The MANA ECU is sold as a competition and off-highway product. It is intended for vehicles used exclusively in off-road, closed-course, and motorsport settings.

  • MANA ECU makes no emissions-compliance claims of any kind. It is not CARB-certified and not EPA-certified, and it has no CARB Executive Order number.
  • Installing it on a vehicle that is registered, insured, or driven on public roads may be illegal where you live. You — the buyer — are solely responsible for knowing and complying with the federal, state, provincial, and local laws that apply to your vehicle.
  • By purchasing, you confirm the product will be used only in applications where its use is lawful.

2. Reservations, deposits & refunds

Founding-batch units are sold by reservation. Your reservation locks your price and your numbered place in the build queue, in the order reservations are received.

  • Deposits apply to your final price. Any deposit you pay is credited in full against the final purchase price of your unit. TODO-TYLER: confirm deposit amount vs. full $750 up front
  • 72-hour hold. If you reserve without paying, your spot is held for 72 hours. If payment isn't received within that window, the spot is released to the next person in line.
  • Refunds before shipment. Deposits and reservation payments are fully refundable on request at any time before your unit ships. Email us and we'll process it — no forms, no arguing.
  • After shipment. Once your unit has shipped, payments are non-refundable. From that point forward the limited warranty below covers you instead.

3. Limited warranty

Every MANA ECU is covered by a 12-month limited warranty against defects in materials and workmanship, starting the day your unit ships. TODO-TYLER: confirm duration & final warranty terms before publishing

  • What we do: if your unit has a manufacturing defect, we will repair or replace it, at our discretion, at no charge.
  • What voids it: physical abuse or impact damage, water ingress past the enclosure seals, overvoltage or reversed polarity, and opening, modifying, or otherwise tampering with the board or enclosure.
  • The warranty covers the ECU itself. It does not cover damage to your engine, harness, or vehicle, consumables (sensors, fuses), or labor and shipping to remove and reinstall the unit. TODO-TYLER: confirm who pays return shipping
  • This warranty is the exclusive remedy and replaces all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent allowed by law.

4. Limitation of liability

This product controls an engine. Correct installation, configuration, and tuning are the responsibility of the installer and operator. An engine management fault — from installation error, mis-tuning, wiring problems, or component failure — can damage an engine or cause a vehicle to behave unexpectedly.

  • You accept that you install and operate the MANA ECU at your own risk.
  • To the maximum extent permitted by law, NextGear Web Services' total liability arising from any product is capped at the purchase price you paid for that product.
  • We are not liable for consequential, incidental, or indirect damages — including engine or vehicle damage, towing, lost use, or lost income — even if advised of the possibility.
  • Some jurisdictions don't allow certain limitations; where that's the case, these limits apply to the fullest extent permitted.

5. Privacy & email

We collect only what we need to build and ship your unit.

  • Reservation data (name, email, vehicle details, shipping info) is used to fulfill your order and support your unit — nothing else.
  • Interest-list signups receive project updates about the MANA ECU. You can unsubscribe any time by replying to any email and saying so.
  • We never sell your data. Not to advertisers, not to "partners," not to anyone.

6. Governing law

These terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Alabama. TODO-TYLER: confirm governing state & venue
